The Chinese job market is in <strong>full growth<\/strong>, it is therefore a very <strong>attractive<\/strong> <strong>market<\/strong> for foreign companies, and before making up your mind and implement over there, you have to <strong>analyze<\/strong> this special market. <strong>Differences in culture<\/strong> between western countries and Asian countries have an<strong> impact on business<\/strong> in general, and that\u2019s why we must know more about the different <strong>Chinese laws<\/strong> and the functioning of their companies before taking the plunge. In this article, we will try to shed a light on this subject by listing the different <strong>procedures required<\/strong> to <strong>work<\/strong> or <strong>recruit in China,<\/strong> in order to make things easier for you if you decide to go ahead and not to get lost in red tape or worse, illegality.<img loading=\"lazy\" class=\"attachment-post-thumbnail aligncenter\" src=\"https:\/\/www.jobboardfinder.com\/news\/wp-content\/uploads\/2017\/06\/young_chinese_professionals-min.png\" sizes=\"(max-width: 400px) 100vw, 400px\" srcset=\"https:\/\/www.jobboardfinder.com\/news\/wp-content\/uploads\/2017\/06\/young_chinese_professionals-min.png 400w, https:\/\/www.jobboardfinder.com\/news\/wp-content\/uploads\/2017\/06\/young_chinese_professionals-min-300x239.png 300w, https:\/\/www.jobboardfinder.com\/news\/wp-content\/uploads\/2017\/06\/young_chinese_professionals-min-30x24.png 30w\" alt=\"recruitment in China\" width=\"400\" height=\"318\" \/><\/p>\n<h2>Visa information for all<\/h2>\n<p>As we said in the introduction, <strong>China<\/strong> is a country very demanding when it comes to <strong>procedures<\/strong> and <strong>foreign activities<\/strong>. All foreigners, coming to visit or to work in China are entitled to a <strong>visa<\/strong> and must have a <strong>valid passport<\/strong> (it has to be valid for the whole period you spend in China, at least for <strong>6 months<\/strong>). A <strong>touristic passport<\/strong> (visa L) is generally given for <strong>30 days<\/strong>. Of course, just like in many countries, you won\u2019t be able to <strong>work<\/strong> or to complete an <strong>internship<\/strong> with a touristic passport. Please note that it can be different if you stay in <strong>Hong-Kong<\/strong> (where they are maybe less demanding as it is an open international business city) or in <strong>Macao<\/strong>. For example, <strong>British people<\/strong> don\u2019t need a visa to enter Hong-Kong (according to <a href=\"https:\/\/www.gov.uk\/foreign-travel-advice\/china\/entry-requirements\">the <strong>British Foreign Office<\/strong><\/a>). You apply for a <strong>visa<\/strong> in the<strong> Chinese embassy<\/strong> of your home country or city.<\/p>\n<p>Be careful with your visa, since<strong> January 2013<\/strong>, China has introduced new <strong>sanctions<\/strong> for foreigners entering the Chinese territory, living here <strong>illegally<\/strong> (administrative retention of 15 days, fines, deportation). Chinese authorities can even decide <strong>not to grant you<\/strong> a visa if they consider that your presence on their soil as a <strong>danger<\/strong> to their security (because of <strong>previous travels<\/strong> for example). According to the <strong><a href=\"http:\/\/www.diplomatie.gouv.fr\/fr\/conseils-aux-voyageurs\/conseils-par-pays\/chine\/\">French Foreign Office<\/a><\/strong>, \u201cmany European embassies have seen many visa requests being <strong>denied<\/strong> by the Chinese government or citizens refused at <strong>entry<\/strong> even though they had an <strong>in due form visa<\/strong>\u201d.<img loading=\"lazy\" class=\"attachment-post-thumbnail aligncenter\" src=\"https:\/\/www.jobboardfinder.com\/news\/wp-content\/uploads\/2017\/06\/chinese-visa-min.png\" sizes=\"(max-width: 400px) 100vw, 400px\" srcset=\"https:\/\/www.jobboardfinder.com\/news\/wp-content\/uploads\/2017\/06\/chinese-visa-min.png 400w, https:\/\/www.jobboardfinder.com\/news\/wp-content\/uploads\/2017\/06\/chinese-visa-min-300x134.png 300w, https:\/\/www.jobboardfinder.com\/news\/wp-content\/uploads\/2017\/06\/chinese-visa-min-30x13.png 30w\" alt=\"chinese visa\" width=\"400\" height=\"178\" \/><\/p>\n<p>Also, since <strong>February 2017<\/strong>, according to the new legislation of the <strong>People\u2019s Republic Administration for Entry-Exit<\/strong>, foreign people (aged from 14 to 70) arriving in China could be subjected to <strong>fingerprinting<\/strong> (in airports and ports).<\/p>\n<p>So in a nutshell, if you want to abroad and try your luck there, stay <strong>informed<\/strong> about China and its relationship with your <strong>country of origin<\/strong>, be in compliance with the <strong>Chinese laws<\/strong> and keep your <strong>passport<\/strong> with you.<\/p>\n<h2>Legal documents for companies<\/h2>\n<p>Implementing in China is something very <strong>difficult<\/strong> for foreign companies. You have to get <strong>visas<\/strong>, check with the <strong>Chinese Communist Party<\/strong> and with the local administration (called the CIIC \u2013 <strong>China International Intellectech Corporation<\/strong>).<\/p>\n<p>We found on a <a href=\"https:\/\/wiredcraft.com\/blog\/legal-documents-china\/\">blogpost<\/a> a list of all <strong>required documents<\/strong> for companies that are either willing to:<\/p>\n<ul>\n<li>Open a <strong>subsidiary<\/strong> in China<\/li>\n<li>Have an <strong>office<\/strong> there<\/li>\n<li><strong>Recruit<\/strong> in China<\/li>\n<li>Publish on a <strong>job board<\/strong> in China<\/li>\n<\/ul>\n<p>We will give you the most<strong> important<\/strong> documents, but if you need more information, you can check this very complete <strong><a href=\"https:\/\/wiredcraft.com\/blog\/legal-documents-china\/\">article<\/a><\/strong>.<\/p>\n<p>&nbsp;<\/p>\n<h3>Business Licence<\/h3>\n<p>Proves that your company is <strong>real<\/strong> and <strong>lawful<\/strong>. Your company name has to appear in <strong>Chinese<\/strong> too, with an address and an <strong>incorporation number<\/strong> (a legal number like SIRET in France, Tax Identification Number). For them, it is an <strong>Organization Code Certificate<\/strong>, which you have to get too. There must be <strong>official stamps<\/strong>. It must be <strong>signed by a legal person<\/strong>.<\/p>\n<h3>Certificate of Approval<\/h3>\n<p>Only given to foreign companies, this certificate proves the \u201c<strong>legitimacy<\/strong> of enterprises established with <strong>foreign investments<\/strong> in China\u201d.<\/p>\n<h3>Taxes Registration Certification<\/h3>\n<p>It proves that the company is registered in the <strong>SAT (State Administration of Taxation)<\/strong> and <strong>Local Tax Bureau<\/strong>. Don\u2019t ever forget to pay your taxes, even if you\u2019re a foreign company!<\/p>\n<h3>Certificate of Registration<\/h3>\n<p>We had to deal with this certificate when we wanted to<strong> buy adverts<\/strong> on one of the biggest job board in China, 51job.
